1. General
1.1 - 'Home Creations (UK)
Limited', are the sole owner of the homecreations.co.uk. No terms and conditions
put forward by the customer, any verbal representation, guarantees, or other
statements made by or on behalf of HCUK, shall be binding unless confirmed in
writing by a director of HCUK. Your statutory rights are unaffected by these
terms and conditions. We advise you to read this page carefully and if necessary
print them for your reference.
1.2 - We reserve the right
to amend these terms and conditions when applicable. It is your responsibility
to check any changes that have been made and we deem your continued use to be
acceptance of these changes.

2. Use of this wesbite
To be eligible to place
orders on a Home Creations (UK) Ltd website you must fulfill the following;
- Be of 18 years or over
- Orders must be accompanied by your real name, cardholders billing address,
a landline phone number, e-mail address and any other requested information
during the order process.
- A valid UK delivery address
- Use a valid credit/debit issued by a bank accepted by Home Creations (UK)
Ltd.

3. Privacy policy
We are committed to protecting
your privacy and we comply with the Data Protection laws applicable to business
in the UK.
We only use the information we collect about you to process orders and to provide
a more personalised shopping experience. We continually monitor web statistics
including site usage and search engine patterns to help us develop the design
and layout of our web site. This in no way affects our customer's privacy.
Home Creations (UK) Limited do not disclose buyers' information to third parties other than when order details are processed as part of the order fulfilment. In this case, the third party will not disclose any of the details to any other third party. We do not send unsolcitored e-mail's to our customers or potential customers.
Cookies are used on this shopping site to keep track of the contents of your shopping cart, to store delivery addresses if the address book is used and to store your details if you select the 'Remember Me' Option. strive to provide accurate and current information on this website, information
contained in this site may contain technical inaccuracies or typographical errors.
All liability of Home Creations (UK) Limited howsoever arising for any such
inaccuracies or errors is expressly excluded to the fullest extent permitted
by law.

5. Payment & prices
5.1 - All prices are in
UK Sterling and inclusive of United Kingdom Value Added Tax at 17.5%.
5.2 - Any quotation or
published price is subject to alteration or withdrawal without prior notice
as a result of fluctuation in exchange rates, increase in supplier's prices,
error in published price or other costs beyond our control. Statement of price
or a quotation does not constitute an offer. We will inform you of the correct
price where the right to cancellation can be exercised.
5.3 - Payment by credit/debit
card or cheque will require clearance prior to delivery. All card payments are
subject to security checks before any goods are dispatched. If the issuing bank
of your card does not for any reason authorise payment from that account, the
order may be delayed or cancelled.
5.4 - Title to the goods
will remain with HCUK until full payment is received.

6. Product Availability
6.1 - All products are
subject to availability. We will endeavor keep you fully informed of your order
status.
6.2 - We reserve the right
to withdraw any product or offer from the website at our discretion, including
the refusal of any transaction attributed to those products / offers.

7. Delivery
7.1 - Whilst every effort
will be made to adhere to stated delivery dates, such dates are estimates only
and HCUK cannot be liable for any losses incurred caused by delay in delivery.
7.2 - It is the customer's
responsibility to ensure that adequate access is made to the property in order
for delivery to take place and that they or an authorised person are present
to receive the delivery.
7.3 - Visible damage (i.e.
after removal of all packaging) must be reported by telephone within 24 hours
and confirmed in writing within 72 hours. Please do not use the item if you
wish to make a claim for damage.
7.4 - This procedure must
be carried out even if someone has been appointed to take delivery on your behalf.
Having received the goods they will be held at your own risk and we will not
be liable for their loss or destruction.

8. Faulty goods & guarantees
8.1 - All products are
supplied with at least 12-month parts and labour manufacturer's guarantee (United
Kingdom). This will exclude faults caused by accident, neglect, misuse or error
in installation.
8.2 - In the case of manufacturers who operate direct product support, repairs & returns procedures, the Customer is advised to process their claim directly through the manufacturer in the first instance.
8.3 - HCUK make no representation
and accept no liability in respect of purchased goods which are subsequently
exported.

9. Cancellation / return of goods by customer
9.1 - You must obtain
authorisation from Home Creations before you attempt to return goods. Failure
to obtain authorisation will cause the returned goods to be rejected.
9.2 - Proof of purchase
must be provided.
9.3 - You have the right
to return the goods within 7 days of receiving them, provided they are in pristine
condition AND IN ORIGINAL PACKAGING and in a resalable condition.
The customer will be responsible for the cost and safe return of the goods.
When this is satisfied a refund will be made within 30 days.
9.4 - A technical diagnostic
examination is always carried out prior to any replacement or refund.
9.5 - Refunds will only
be issued if the goods in question are returned by you and received by us in
the condition they were sent out. If you do not return the goods delivered to
you or do not pay the costs of delivery, we shall be entitled to deduct the
direct costs of recovering the goods from the amount to be re-directed to you.
9.6 - We will not be able
to provide a full refund or exchange for an item when it has been ordered for you (i.e. Awaiting Stock and displays "Usually delivered within 5 working days" in the product description). These items will require a restocking charge
set by the manufacturer, typically 25% of the order value.
9.7 - We reserve the right
to deem the goods second-hand and make you an appropriate offer should any items
not be returned in their entirety or in an 'as new' condition.
9.8 - In the event of an
authorised return being sent back by the customer (only for a faulty product)
a maximum of £7 return carriage charge will be credited to any refund.
9.9 - Whilst we will make
every attempt to remedy this type of situation, we must emphasise it is in everyone's
interest to ensure that the correct items are being ordered and are suited to
your particular requirements.

10. Cancellation by HCUK
We reserve the right to
cancel the contract between us if; i) we have insufficient
stock to deliver the goods you have ordered.
ii) we do not deliver to your area.
iii) one or more of the goods you ordered was listed at an incorrect price due
to a typographical error or an error in the pricing information received by
us from our suppliers.

11. Events beyond our control
HCUK shall have no liability
for failure to deliver goods ordered or any delay in doing so or for any damage
or defect to goods delivered that is caused by any event or circumstance beyond
our reasonable control including, without limitation, strikes, lock-outs, industrial
disputes, breakdown of systems or network access, flood, fire, explosion or
accident.

12. Other
If any part these terms
and conditions shall be found to be unlawful it shall not affect the validity
or enforceability of the remainder of the conditions. This contract is and shall
be deemed to have been made in England and shall in all respects be governed
by English Law.
